Constitutional petition for online rights

 

On the 17th of April 2012, seven individuals, Awab Alvi, Sana Saleem, Faisal Kapadia, Nazim Haji, Naeem Sadiq, Noman Quadri and Ayesha Tammy Haq through their lawyer Haider Waheed & Basil Nabi Malik, petitioned the High Court of Sindh at Karachi challenging the arbitrary and random acts of the Pakistan Telecommunication Authority (PTA) in blocking/ censoring and restricting access to various websites in violation of the fundamental rights of the owners of the websites/online forums as well as the public at large, and without affording the aggrieved persons an opportunity of being heard or due notice.  It was prayed in the said petition that no website could be blocked/ censored or restricted without affording the aggrieved parties (including the public at large) due notice and an opportunity to be heard in accordance with Articles 4, 9, 10-A, 18, 19, 19A, 20 and 25 of the Constitution of Pakistan, 1973, read with Section 6 of the Pakistan Telecommunication Authority Act, 1996.  The Honorable High Court of Sindh issued notice to the Federation of Pakistan, through the Secretary, Ministry of Information Technology and Telecommunication, and the Pakistan Telecommunication Authority, through its Chairman, and furthermore ordered the PTA said not to block any website other than in accordance with the provisions of the Pakistan Telecommunication (Re-Organization) Act, 1996.  It may be noted that as per the PTA Act, the correct procedure to be followed before blocking or censoring of websites is as per Section 6 of the said Act, which states,

 

Section 6.

Responsibilities of the Authority.—In exercising its functions and powers under this Act, the Authority shall ensure that—

(a) Rights of licensees are duly protected;

(b) All of its decisions and determinations are made promptly, in an

Open equitable, non-discriminatory, consistent and transparent

Manner;

(c) All applications made to it are disposed of expeditiously;

(d) The persons affected by its decisions or determinations are given a

due notice thereof and provided with an opportunity of being

Heard;

(e) Fair competition in the telecommunication sector exists and is

Maintained

(f) The interests of users of telecommunication services are duly safeguarded and protected.

The intention of the said petition was to bring the entire process under judicial review to insure its fairness, transparency, to prevent ad hoc blocking, to provide a proper system of redress to the parties owning these websites and forums and to protect the fundamental rights of the public at large including internet users in Pakistan.

“Notice to the Respondents as well as learned DAG for 07-05-12, to be issued instantly and through all possible modes, till then the Respondents shall conduct themselves strictly in accordance with law and in case, they initiate any action, such shall be done in accordance with relevant provisions of Pakistan Telecommunication Authority Act, 1996.”

Happy new year 2012

The new year is going to be here in 3.5 hours. Karachi is going to welcome it like it does every year.  Sporadic gun fire, car horns, people doing crazy stunts on motorcycles, the have’s partying either at friends places or at various “charity” balls. The have nots gathering at sea view or trying to get there as their way is barricaded with various containers and such obstacles and the hope always the hope for a better year ahead.

Pkrelief update

Relief initiatives completed this week

1) Abdul Sattar Ishaqani and Nishat wellfare organization combined with us to bring relief in the form of 500 ration hampers as well as medicines and a medical camp to the area of Sanghar. Pictures of this undertaking are available here

2) Hamid Yahya and his team from CFC took their team to sanghar and we supported them with 300 ration hampers, 450 litres of water and medicines. Pictures of this undertaking are available here

3) Alhuda’s team went to Sujawal and we supplied them anti malaria medicine for 400 patients.

4) We started a Kitchen In Khorwah, about an hours drive from badin with the help of our team member Salim Khan to bring cooked meals of Water and beef to 750 people daily. This kitchen has been working all of last week and pictures of our cooked meal distribution are available here.

5) We have also received a donation for 10,000 fruit juice packs and have sent half of these to badin already, they will arrive and be distributed tomorrow.

Initiatives to come

  • We plan to continue our kitchen in Khorwah for the next ten days, we are also trying to increase the size of the people served from 750 daily to 1500
  • We have acquired 1000 malaria nets (self standing) and will distribute them in different areas
  • We are in touch with LRBT through Afia Salam and plan to provide eye treatment to the host of families that have arrived on the highway in Karachi
  • We are in touch with rangers to liaison with and provide relief in the shape of ready to eat meals to places where we as a relief team cannot reach personally or through our contacts.
  • We are planning and will organize a medical camp as soon as we get adequate supplies of medicine and doctors..currently medicines are in really short supply due to hoarding.

As you have probably noticed , our focus in on immediate relief right now. This is because there are according to conservative estimates more than 8 million people on the roads od Sindh right now. So the real desperate need is of cooked food, water, juice, rations, anti malaria and malaria preventive medicine, mosquito nets and so on.  Rehabilitation plans will come later, first we need to ensure that these people do not die of hunger or sickness.

We at Sarelief do not believe in waiting for the right time to distribute aid, we believe every moment is precious and thus try to get aid to the ground as fast as possible and through partnering with any reliable organization. We also do NOT charge fuel expenses, travelling expenses, food lodging or any other kind of administrative overheads thus insuring that every single penny of your aid gets to the needy, not some percentage of it.

We appeal to every single one of you to help our pakistani brethren out of this tragedy, whether it is by donating to us or to any other reliable organization on the ground!!

Launch of pictorial biography of Altaf Hussain

I had the pleasure of attending a very interesting event today, which was the launch of a pictorial biography by Rasheed Jamal on the leader of the MQM “Altaf Hussain”

Born in Sept of 1953 this student leader has not only galvanized the middle class immigrant minority of Karachi into becoming its strongest party in his tenure, but has also seemed to foretell what turn future events would take in the hotch potch of our countries politics. Perhaps this is why his party always seems to end up on the right side of the book when the pages of politics turn. Surprisingly enough for some people who still think of MQM as a party based on sectarian politics  it has emerged as a secular force not only in this city but across Pakistan as its cadres include the most educated and literate people in this country. It is the only party in my knowledge who takes people up from the grass roots level of community and sits them in the halls of power.

The proceedings for the launch were quite well organized and started off at around 7pm today at the Karachi Marriot hotel, which was heavily secured obviously as a number of leaders from MQM and other parties as well as Governer Isratul Ibad who was the chief guest & some counselor generals were in attendance. Upon being seated just a cursory glance was enough to tell one that the who’s who of Karachi’s educational as well as urdu literati were present for this occasion along with every media channel in the book. One thing I absorbed today was that the english journalists of our country, do not have 1/ 3rd the aura of our urdu press and its zauq.  Rather than go into the details of the ceremony, I would choose this moment to try to explain what people do not understand about the  absolute worship which Mr Altaf Hussain gets from his followers. Its not fake or made up, you can literally see it in their faces right from the party worker to the MNA’s who were literally helping people sit in their places.  I do not know about you but I have yet to see a party where its most powerful representatives work side by side with party workers except for MQM.

Well for that answer you have to see it, firstly it has some 2000 pictures of the entire movement and its leader in small and large formats. However where it is totally apart to this scribe from the other autobiographies he has collected over the years is in the pictures itself. Where you will find other leaders autobiographies showing pictures of them  standing with party posters, here you will find a young Altaf Hussain tying posters of his party to the telephone poles himself. Where in other autobiographies you will see leaders tucking into enormous feasts, here you will see a young man with his friends as a student leader sitting on the ground and having samosas in torn newspapers like anyone else in this cities masses. This is the difference in this man and the rest of our leaders to me, he is one with his people, one with those that follow him. They do not worship him because of what he is, but what he represents in his party which is equality.

In any case I would recommend all of my readers to buy this book, its an experience going through it and should be a welcome addition to any collectors shelf. Perhaps it can even go some way in explaining what it is that makes Altaf Hussain what he is.

I would like to leave you with a few shairs some members of our glittering urdu press whom I had the honor of sitting with imparted to me, as they curiously peeked over my shoulder at me twittering.

Deadpan thoughts 3.0

Its been a year and half since the launch of Deadpanthoughts. At first it started off as a blog on wordpress.com @ www.faisalk.wordpress.com, from there last year I got my own domain and courtesy of some friends set up my own website at the addy you are at now.

Since then I have been demanding a shift to web 2.0 standard graphix from myself but aside from trying on new themes I had little option as my graphics experience is well… limited.

So came the excellence theme and I sort of liked it for a good time, but it was too plain and too common, yeh I had gotten vain by now and wanted something no other person had on their blog. This is where Enk came in, who is a 18 yr old web designer from Hyderabad and I have succesfully been eating his head for the past 3 days to get to where we are today.

Thus without further ado I present the new Deadpan Thoughts Web 2.0 version with better styles a cleaner look, post thumbnails, threaded gravatar comments and a customized theme by elogoEnk. He swears by it and claims loading times shall improve as well now, in any case I thank you for putting up with the disturbance and the clutter for the last day or so and hope you enjoy the new Deadpan!!
